EvaCore provides a B2B SaaS platform that includes an AI-powered real estate assistant, email and CRM integration, and related tools. The Service is operated in the United States and is intended for use by real estate professionals and agencies in the US market.
3. Account Registration
You must register for an account to use the Service. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.
4. Subscription and Payment
- EvaCore offers subscription plans billed monthly or annually.
- Payments are processed securely through Stripe (PCI-DSS compliant).
- Subscriptions auto-renew unless cancelled before the renewal date.
- Refunds are not provided for partial billing periods unless required by applicable law.
- We reserve the right to modify pricing with 30 days' notice.
5. AI Communications
Eva, our AI assistant, communicates with your leads on your behalf via email and other channels you connect. You acknowledge that AI-generated responses may not always be perfectly accurate. You are responsible for reviewing AI communications and ensuring they comply with applicable laws, including the CAN-SPAM Act and any relevant real estate communication regulations. EvaCore is not liable for any inaccuracies in AI-generated messages.
6. Acceptable Use
You agree not to use the Service to:
- Send spam or unsolicited messages.
- Violate any applicable local, national, or international law or regulation.
- Infringe upon the intellectual property rights of others.
- Transmit harmful, fraudulent, or deceptive content.
- Attempt to gain unauthorized access to the platform or its infrastructure.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You retain ownership of your data. We process your data and your clients' data only as necessary to provide the Service. We do not sell any data to third parties.
8. AI-Generated Content
The Service uses AI models to generate responses on your behalf. You acknowledge that AI-generated content may not always be accurate. You are responsible for reviewing and supervising AI communications sent to your clients. EvaCore is not liable for any inaccuracies in AI-generated messages.
9. Intellectual Property
EvaCore and its original content, features, and functionality are owned by EvaCore and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
10. Limitation of Liability
To the maximum extent permitted by law, EvaCore shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability to you shall not exceed the amount you paid to us in the three months preceding the claim.
11. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may cancel your subscription at any time through the billing portal. Upon termination, your access to the Service will cease and your data may be deleted after a 30-day grace period.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or platform notification. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
